Yes it would be wrong, since you are trying to use the name that does not
belong to you for your own ends. This in not the high-seas, you can't
declare things abondoned and then take them.

You do not need a registered trademark to have a prior claim to something.
No IP lawyer would allow you to use this name in a commercial setting.
