I've noticed the same thing. MSXML seems to do an awful lot of validation when validation is turned off.
On another note, I've been contacting some sites that have RSS feeds with the bad DTD reference and explaining the problem and how to fix it. So far Wired News has fixed theirs by referencing a local copy of the DTD. I'm hopeful that others will as well.
